MAKNA HARI PEKERJA

Cuti umum sempena Hari Pekerja yang disambut oleh pekerja-pekerja tempatan pada hari ini merupakan kali yang ke-29 dalam sejarah negara ini apabila bekas Timbalan Perdana Menteri, Allahyarham Tun Dr. Ismail Abdul Rahman mengumumkan tanggal 1 Mei sebagai hari kelepasan am bagi pekerja Malaysia pada tahun 1972.
Pengumuman itu dibuat dalam ucapannya ketika merasmikan Seminar Kesatuan Sekerja Biro Buruh dan Kesatuan Sekerja UMNO yang diadakan di Dewan Belia, Kampung Pandan pada 20 Mei 1972.
Dalam penjelasannya, Allahyarham menyatakan bahawa keputusan itu telah dibuat dengan harapan pergerakan buruh akan menganggap 1 Mei sebagai satu hari dedikasi sesuai dengan cita-cita kebangsaan dan berharap gerakan pekerja akan didorong oleh tujuan dan rasa terikat kepada cita-cita kebangsaan tersebut.
``Pengumuman itu disusuli dengan tepukan gemuruh para hadirin seminar kerana ia merupakan kejayaan yang berharga kepada pekerja,'' kata bekas Setiausaha Agung Kongres Kesatuan Pekerja-Pekerja Di Dalam Perkhidmatan Awam (Cuepacs), Jamaluddin Mohd. Isa dalam pertemuan dengan Utusan Malaysia baru-baru ini.
Mengulas lanjut pengalaman beliau ketika saat-saat kejayaan memperoleh cuti umum itu, Jamaluddin, salah seorang anggota biro berkenaan, menjelaskan: ``Pengumuman itu signifikan kerana Malaysia secara tidak langsung mengiktiraf Hari Pekerja yang diluluskan oleh Konvensyen Pertubuhan Buruh Antarabangsa (ILO).''
Jamaluddin, kini Setiausaha Kerja Kesatuan Pegawai-Pegawai Hutan Melayu Malaysia Barat, menambah: ``Saya rasa sungguh bertuah kerana berpeluang memainkan peranan dalam merealisasikan tuntutan meskipun ia sebenarnya telah diperjuangkan oleh Cuepacs dan MTUC (Kongres Kesatuan Sekerja Malaysia).''
Langkah itu sekali gus meninggikan martabat dan kedudukan negara di peringkat antarabangsa, ujarnya.
Mengimbas kembali peristiwa bersejarah hampir tiga dekad yang lalu, bekas Pengarah Pendidikan MTUC, S. Radhakrishnan pula berkata, pendekatan yang diambil oleh kerajaan ketika itu telah menyumbang kepada situasi perundingan bukan konfrontasi.
``Sejak itu hubungan antara kerajaan dan kesatuan sekerja bertambah baik, suasana yang sangat positif di mana wujud keadaan boleh menyatakan pendirian tidak setuju dalam erti kata yang boleh dipersetujui, bukan konfrontasi,'' kata beliau yang juga bekas Presiden Majlis Tindakan Sosial Pendidik Malaysia, yang dipinjamkan sebagai Pengarah Pendidikan MTUC selama dua tahun mulai 1974 oleh kerajaan.
Hasil hubungan baik itu, kata beliau, kerajaan juga telah meluluskan cadangan MTUC untuk menubuhkan Bank Buruh pada tahun 1975.
``Projek ini membolehkan MTUC menerokai bidang-bidang baru,'' jelasnya. Bekas guru itu yang kini merupakan perunding firma guaman di Kuala Lumpur menambah, 1 Mei sebenarnya dianjurkan untuk melihat paras pencapaian semasa dan langkah-langkah yang perlu dilakukan demi memperbaiki kedudukan masa akan datang.
``Selain itu, 1 Mei bertujuan memberi pengiktirafan ke atas perjuangan lalu dalam pembangunan negara dan sumbangan para pekerja,'' katanya.
Sebenarnya kesatuan-kesatuan pekerja negara ini menyambut Hari Pekerja sebelum kerajaan mengisytiharkan cuti umum.
Usaha itu disusuli dengan tindakan V. David (ketika itu anggota Dewan Perwakilan dan Setiausaha Agung Kesatuan Kebangsaan Pekerja-Pekerja Kilang dan Am) membawa usul menuntut cuti seumpama itu pada 24 Februari 1960.
Dalam buku yang dikeluarkan sempena Hari Pekerja 1973, Kesatuan Pekerja-Pekerja Pengangkutan Malaysia menyifatkan tahun 1972 sebagai sinar harapan bagi kelas pekerja kerana perubahan pada pendirian kerajaan.
Sambutan Hari Pekerja tidak disambut pada hari yang sama oleh setiap negara yang mengiktiraf Konvensyen ILO yang berkaitan. Pada tahun 1884, Persekutuan Kesatuan Buruh dan Pekerja Berkesatuan meluluskan resolusi yang menggariskan kerja lapan jam sehari yang sah mulai 1 Mei 1886. Resolusi itu juga menggesa diadakan mogok umum untuk mencapai matlamat memandangkan pendekatan perundangan menemui kegagalan. Kira-kira 250,000 pekerja berhimpun pada gerakan Hari Mei. Bagaimanapun rekod juga menunjukkan Hari Pekerja telah mula disambut pada September 1882 di Amerika Syarikat.
``Oleh itu, tidak semua negara menyambut Hari Pekerja pada 1 Mei. Pada peringkat permulaan, negara-negara fahaman komunis menyambut hari keistimewaan ini pada 1 Mei, manakala yang bukan komunis pada hari-hari yang lain,'' kata Setiausaha Kerja Kesatuan Pekerja-Pekerja Lembaga Getah Malaysia, A.J. Patrick.
Austria, Argentina, Belgium, Jerman, Norway (Hari Mei, 1 Mei), Filipina, Singapura, Afrika Selatan, Sepanyol, Sweden, Thailand, Perancis, Hong Kong, Vietnam, Korea Selatan dan Itali menyambut Hari Pekerja pada 1 Mei, Kanada dan Amerika Syarikat (2 September), Jepun mengenalinya sebagai Hari Terima Kasih Pekerja (23 November), New Zealand (28 Oktober), Britain (6 Mei).
Bekas pemimpin MTUC itu menambah: ``Hari Pekerja pada peringkat awal disambut sebagai hari patriot untuk perjuangan kebajikan pekerja-pekerja.
``Tetapi, hari ini ia dilihat sebagai satu hari yang berlainan.''
Di peringkat awal kesatuan-kesatuan mengadakan mengikut kemampuan masing-masing, termasuk menganjurkan rapat-rapat umum dengan dihadiri antara 3,000 hingga 4,000 orang.
``Kini kemudahan bertambah baik, banyak kemudahan pengangkutan diadakan. Sambutan anjuran kerajaan pula menyediakan anugerah dan hadiah pengiktirafan kesatuan dan pekerja terbaik.
``Cara sambutan berbeza. Kesatuan sekerja seharusnya lebih ke depan dalam menganjurkan sambutan Hari Pekerja,'' kata Jamaluddin dengan merujuk cara sambutan peringkat Cuepacs pada masa sekarang.
Tambah beliau, ``pekerja-pekerja tidak merasai makna sebenar sambutan. Kesatuan tidak harus tenggelam dalam suasana sedemikian.'' Pengalaman lalu menunjukkan ucapan-ucapan pemimpin kesatuan lebih bersifat `mengapi-apikan' semangat para pekerja. Kini ia berubah sama sekali.

Self-checks over safety and health rules mulled

PUTRAJAYA: The Human Resources Ministry is working on a self-regulatory system for companies to hold professionals responsible for failing to comply with safety and health regulations.

Its minister Datuk Dr S. Subramaniam said a similar system was implemented in various countries including Canada where professionals could lose their licences for failing to comply with the regulations.

The idea, he said, was mooted after seeing the ministry’s inspection teams’ heavy task when conducting about 147,000 checks annually on worker safety and health measures.

“We are now looking at the system used overseas as well as our needs here and we will also need to seek amendments to the Occupational Safety and Health Act 1994,” he told reporters after launching the World Occupational Safety and Health Day 2009 celebrations here yesterday.

Dr Subramaniam, who also launched a booklet on Smart Guide to Occupational Safety and Health, said the booklet would help stop employers from claiming ignorance when they were reprimanded for failing to comply with regulations.

Copies of the booklet, he said, would be given to new business operators when they go to the Registrar of Companies or commercial banks where they got their loans.

On the current level of compliance in the various industries, Subramaniam said it was generally good with only about 4% of employers taken to court for gross failure to follow regulations.

He said the industrial accident rate in Malaysia was almost the same as that in developed countries.

Dr Subramaniam said the ministry was working with the Education Ministry to incorporate occupational safety and health topics in the existing school syllabus to instill safety awareness at an early age.

Drop foreign workers first, says Subra

EMPLOYERS facing financial difficulties should lay off foreign workers before attempting to terminate their local staff, Human Resources Minister Datuk Dr S. Subramaniam said.

Investigations showed that some employers practised two salary schemes, one for locals and another for foreigners , Makkal Osai quoted him as saying.

They would pay local workers through the normal process but would outsource salary payment for foreign staff to agents, he added.

> Tamil Nesan reported MIC’s concerns that many Indians might not have the financial means to take up the 15% quota of Amanah Saham Malaysia shares allocated to the community.

Its president Datuk Seri S. Samy Vellu said that as of last Wednesday, Permodalan Nasional Berhad stated that Indians had bought only 10.7% or 53.5 million units of the quota given to them compared with the Chinese who had taken up 999 million ASM units.

He proposed that the Government assist the Indians by providing partial grants or loans to buy the shares.

KUALA LUMPUR: Menteri Sumber Manusia, Datuk Dr S Subramaniam, kesal dengan sikap pencari kerja apabila hanya 7,000 daripada 20,000 peluang pekerjaan disediakan berjaya diisi sepanjang tiga bulan lalu.

Subramaniam berkata, jumlah itu disifatkannya terlalu kecil berbanding peluang pekerjaan yang disediakan.

Katanya, antara faktor penyumbang kepada masalah ini ialah pencari kerja terlalu memilih, malah ada yang mendapat kerja tetapi tidak melaporkan diri.

“Saya sangat tidak puas hati dengan situasi ini (kerana) walaupun banyak peluang pekerjaan tetapi gagal diisi dan saya fikir mereka (pencari kerja) terlalu memilih pekerjaan. Mereka yang diberhentikan kerja juga perlu bersedia untuk meneroka bidang pekerjaan baru,” katanya.

Doktor temui pokok dalam paru-paru



ZHEVSK, Rusia - Adakah anda masih ingat pesanan orang tua yang memberitahu supaya jangan menelan biji tembikai kerana takut benihnya akan tumbuh dalam perut?

Pesanan itu mungkin dianggap tidak munasabah tetapi beberapa doktor di sini terkejut apabila mendapati sebatang pokok fir kecil berdaun hijau setinggi lima sentimeter berada dalam paru-paru seorang pemuda, Artyom Sidorkin yang berumur 28 tahun.

Menurut sebuah akhbar semalam, Sidorkin pergi ke Pusat Kanser Udmurtian di sini, Rusia Tengah pada minggu lalu kerana batuk berdarah dan sakit dada.

Akhbar Komsomolskaya Pravda melaporkan, doktor-doktor pada awalnya mendapati terdapat tumor di dalam salah satu paru-parunya berdasarkan ujian X-ray tetapi setelah dibedah, mereka terkejut menemui pokok kecil itu.

"Mata saya berkedip-kedip sebanyak tiga kali kerana menganggap saya melihat benda lain.
"Saya kemudian memanggil pembantu untuk melihatnya semula," kata Dr. Vladimir Kamashev yang membuat pembedahan itu.

Sidorkin berkata, sebelum ini doktor memberitahunya batuk berdarah itu bukan disebabkan dia dijangkiti sebarang penyakit.

"Ia sangat sakit seperti mencucuk dalam saluran badan. Terasa sakit yang amat sangat. Namun saya tidak pernah terfikir ada objek dalam badan saya," kata Sidorkin.

Menurut beberapa doktor, adalah mustahil pokok kecil itu ditelan memasuki paru-paru manusia.

Mereka percaya Sidorkin mungkin menelan benih pokok itu yang kemudian membesar di dalam tubuhnya.

Sebahagian paru-paru Sidorkin dan pokok itu diawet untuk kajian lanjut.

Measures to better protect workers making Socso claims

MALACCA: The Human Resources Ministry is pushing for changes to better protect workers claiming disability pension under the Social Security Organisation (Socso).

Minister Datuk Dr S. Subramaniam said aspects of the Employees Social Security Act would be looked into, particularly to make the disability pension scheme clearer so that applicants know exactly what it was about and how their problem could be managed.

Among the issues to be sorted out, he said, was lowering the percentage of permanent disability for a worker to be eligible for the scheme from 60% to 40%.

Dr Subramaniam was speaking to reporters after opening the National Update Medical Seminar for Estate Hospitals Assistants here yesterday.

On a separate issue, he said, the ministry was working closely with the Health Ministry and the Malaysian Agricultural Producers Association to set up government clinics in rubber plantations.

He noted that over 350,000 workers in some 3,500 rubber plantations in the country relied on 426 clinics set up by the estate management. He said the clinics were manned by 321 full-time and 91 part-time hospital assistants.

“This has been the situation since pre-independence where the responsibility for health services in plantations was borne by the management.

“What we want to do now is to ensure that the Government provides health amenities in plantations,” he said, adding that the matter had been brought to the Cabinet’s attention.

This would encourage more locals to work in plantations, resulting in lower dependence on foreign labour, he added.

At present, 55% of the 350,000 workers are locals who are employed in the upper management and the rest foreigners.

Skuad Khidmat Cepat (SKC) merupakan satu mekanisme perkhidmatan yang bersifat proaktif dan preventif untuk menghalang danmenyelesaikan sebarang masalah pertikaian perburuhan di antara pekerja dengan majikan yang akan wujud secara pantas dan berkesan di tempat kejadian. Matlamat SKC ialah untuk :

Mengelak terjadinya konflik perburuhan di tempat pekerjaan ;

Mengekalkan suasana perburuhan yang harmoni di tempat pekerjaan.

Mempastikan konflik tidak berpanjangan hingga mencetuskan pertikaian yang boleh menjejaskan operasi syarikat atau perniagaan.

Jabatan Tenaga Kerja juga bertanggungjawab membantu menyelesaikan masalah pekerja/majikan yang berkaitan dengan isu-isu perburuhan.

Menghantar surat ke Jabatan Tenaga Kerja yang berdekatan;

Conciliation may be made compulsory to resolve IR cases faster

PUTRAJAYA: The Human Resource Ministry is looking to make conciliation compulsory each time affected workers report their case to the Labour Department as part of a move to help resolve their cases faster.

Its minister Datuk Dr S. Subramaniam said under the current system, affected workers had the option of whether to seek conciliation or have the matter referred to the Industrial court directly to hear their case.

He said the problem was that when the workers opted to take their case to court it had to be first referred to the Human Resource Minister for decision on whether there was a valid case and this meant looking through some 3,000 cases yearly.

This together with all the court proceedings at times meant the complainants had to wait for up to three years, at times, for a decision, he said.

“We have already introduced the conciliation system under the Labour Department to some extent and have trained and are training staff in the field with help from the International Labour Organisation (ILO).

“The service has proven successful and has helped reduce the number of cases referred to court to about 700 last year from over 2,000 before that,” he told a press conference after handing out Excellent Service Awards to over 500 of the ministry’s officers here Thursday.

Subramaniam said about 170 trained officers were based at all 13 of the Labour Department’s state branches and they would take up the task to conciliate between the workers and employers right after the report was made. This way the branches had settled about 65% of the cases reported to them.

“When the officers at the state cannot solve the problem the matter is referred to our ‘super experts’ at the headquarters (in Putrajaya) and it is only referred to the Industrial court if they too cannot find an amicable solution,” he said.

He said the ministry would have to seek amendments to the Industrial Relations Act 1967 in order to make conciliation compulsory and was most likely do so next year as it had to create a strong and able service first.

On the job matching efforts by the ministry, Subramaniam said the ministry would launch next month its latest effort in the shape of the Community Employment Support Service that would Labour Department officers being based at 106 centres nationwide to offer guidance to the unemployed.

He said 22 of the centres would be placed in highly visited places, such as shopping centres, while the rest would be at the respective Labour Department offices.

He said he was following up the Jobs Malaysia job-matching portal and would provide the human touch that would help to increase the standard of service offered.

As at April 7 there were 27,116 retrenched workers, 7,386 who had been given the voluntary separation scheme, 17,268 temporarily stopped from work and another 28,000 facing salary cuts.

“We are trying to raise our service to help all these categories of workers and we even plan to launch a promotion for the portal so more will register with us,” he said.

Subramaniam said the portal already offered all jobs under the Public Services Department and the private sector and was now working on also putting online jobs in the police force and armed forces.

This, he said, would make the portal the single largest online job-matching service in the country.

Minister: 31,161 workers out of jobs so far

KUALA LUMPUR: A total of 31,161 workers have been retrenched or laid off through voluntary separation schemes (VSS) between Oct 1 and April 15 this year, says the Human Resource Ministry.

Minister Datuk Dr S. Subramaniam said 16,288 local and 7,164 foreign workers had been retrenched during the period while 6,921 local and 788 foreign workers had been laid off through VSS.

“The retrenchment was anticipated across all occupational categories including managerial, professional, technician, clerical, machine operators and plant assemblers during the economic crisis,” he said.

Subramaniam said this in his speech delivered by his deputy Senator Datuk Maznah Mazlan at the MIM CEO Forum 2009 and MIM-Public Bank Manager of the Year 2008 award presentation ceremony.

Meanwhile, 300,000 foreign workers’ contracts had ended in the last six months and their permits were not renewed by the ministry, he added.

Subramaniam said the ministry had initiated three training programmes for employers and workers – Train and Place; Train and Replace; as well as Train and Retain.

“The Labour Department is actively validating job vacancies and facilitating job matching and placement for retrenched workers,” he said.

He said the ministry had also set up 80 operation rooms nationwide to monitor the retrenchment trend daily and to assist retrenched workers by conducting a job placement drive.

“The ministry, under the stimulus economic package, has been allocated RM650mil to implement various programmes to help stimulate the economy, improve Government delivery system and prepare Malaysian workforce with the necessary skills,” he said.

KUALA LUMPUR 16 April – Sebanyak 80 Bilik Gerakan Pemberhentian Pekerja diwujudkan di seluruh negara bagi memantau aliran pemberhentian pekerja setiap hari dan membantu mereka mencari kerja baru.

Menteri Sumber Manusia, Datuk Dr. S. Subramaniam berkata, berikutan itu satu jawatankuasa tiga pihak ditubuhkan bagi menasihati kerajaan mengenai strategi dan langkah yang perlu diambil bagi menangani kesan kelembapan ekonomi.

Beliau berkata, usaha mewujudkan bilik gerakan itu juga menggunakan sebahagian daripada peruntukan sejumlah RM650 juta di bawah pakej rangsangan ekonomi.

“Satu daripada strategi penting ialah Malaysia perlu mengurangkan kebergantungan terhadap pekerja asing, contohnya dengan menguatkuasakan dasar memberhentikan pekerja asing terlebih dahulu,” katanya.

Beliau menyatakan demikian dalam teks ucapan perasmian majlis Anugerah Pengurus Tahunan anjuran Institut Pengurusan Malaysia (MIM) di sini hari ini yang dibacakan oleh Timbalannya, Senator Datuk Maznah Mazlan.

Subramaniam berkata, program-program bagi mengatasi masalah tersebut akan dilaksanakan dengan kerjasama beberapa jabatan seperti Jabatan Tenaga Kerja, Jabatan Tenaga Manusia, Jabatan Pembangunan Kemahiran dan agensi lain di bawah kementerian.

Former exco man slams conciliation plan

IPOH: A former Perak Pakatan Rakyat exco member has criticised Human Resources Minister Datuk Dr S. Subramaniam’s suggestion to make conciliation compulsory for employers and dismissed workers.

Former exco member A. Sivanesan, a labour lawyer for over 10 years, believed that workers could be victimised if they had to attend conciliation meetings with their employer.

He said employers would be represented by qualified personnel like human resource managers but the worker would have to represent himself.

“Under the Industrial Relations Act 1967, the worker cannot be represented by a lawyer in conciliation meetings unless the lawyer happens to be another employee.

“How is the average employee expected to know his rights?

On Friday, Subramaniam was reported as saying that his ministry had improved the conciliation system under the Industrial Relations Department.

He said the department had successfully reduced cases to about 700 last year from over 2,000 previously.

Kanak-kanak berkenaan yang bersekolah di lima pusat asuhan kanak-kanak di ladang iaitu tiga dari Sungai Petani dan dua dari Kulim, menerima sumbangan peralatan permainan itu di Sekolah Jenis Kebangsaan (Tamil) Patani Para, Sungai Petani, Kedah, baru-baru ini.

Penyerahannya dilakukan Menteri Sumber Manusia, Datuk Dr S Subramaniam.

Program yang mula dilaksanakan sejak 1991 itu diteruskan dengan pelbagai peningkatan melalui dasar pendidikan yang diterap melalui prasekolah.

SUNGAI PETANI: Majikan yang enggan memberi pelepasan kepada pekerja mereka untuk keluar mengundi pada pilihan raya kecil di tiga kawasan, 7 April ini, akan berdepan tindakan tegas didenda RM5,000 atau penjara setahun.

Menteri Sumber Manusia, Datuk Dr S Subramaniam, berkata majikan yang menghalang kakitangan keluar mengundi melakukan kesalahan mengikut Seksyen 25 Akta Kesalahan Pilihan Raya 1954 yang memperuntukkan denda RM5,000 atau dipenjarakan maksimum setahun jika sabit kesalahan.

“Majikan perlu memberi masa kepada kakitangan mereka untuk keluar menunaikan hak sebagai pengundi di Parlimen Bukit Gantang, Perak, Dewan Undangan Negeri (DUN) Bukit Selambau, Kedah dan DUN Batang Ai, Sarawak.

“Majikan yang mengingkarinya boleh didakwa dan dikenakan denda sebanyak RM5,000 atau penjara selama setahun,” katanya pada sidang media selepas merasmikan Hari Penempatan Pekerjaan ‘Train and Place’ peringkat Kedah di Village Mall, di sini, semalam.

RM50 MIL TO BE SPENT ON RETRANING

MERSING: The Government is offering RM50mil worth of short-term modular training programmes for workers wanting to upgrade their skills and earn extra income.

Human Resource Minister Datuk Dr S. Subramaniam said this would benefit employees of companies that were temporarily shut down or had reduced working hours.

“We are now facing a situation where workers sometimes have their income slashed by 50%.

“We hope those who have been retrenched or have had their incomes reduced will use the facilities,†he told reporters after attending the launching of the Mersing Industrial Training Institute in Jemaluang by the Tunku Mahkota of Johor, Tunku Ibrahim Ismail Sultan Iskandar.

As of end March, 27,297 workers have been retrenched nationwide, with over 4,686 workers losing their jobs in Johor alone.

Dr Subramaniam said that under the retraining programme, the workers would also be paid an allowance of about RM10 per hour and could use the extra money to supplement their income.

He said this was also another option to help companies reduce operating costs.

The duration of the training programmes was flexible and depended on industry requirements, he said.

Last year, around 75,000 people were retrained in 27 industrial training institutes nationwide. The Government hopes to increase the number this year.

On a separate matter, Dr Subramaniam said the Government was in discussions with job agencies to assist those looking for jobs.

“The Government is also looking at the possibility of giving an allowance if they (the agencies) succeed in providing employment,†he added.
